The law may still require two signatures.

Most of what a foreign buyer checks on a Turkish title deed is about the property: the parcel, the building, the mortgages and the annotations recorded against it. The family residence annotation is different, because it is about the seller. It exists to protect the one asset a family cannot easily replace — the roof over its head — from being disposed of by whichever spouse happens to be named on the register.

Article 193 of the Turkish Civil Code sets the general position, and it is a liberal one: unless the law provides otherwise, each spouse may enter into any legal transaction with the other and with third parties. Article 194 is the exception that immediately follows. Under its first paragraph, neither spouse may terminate the lease relating to the family residence, transfer the family residence, or limit the rights over it, without the express consent of the other. Ownership is not the test. The use of the property is.

That restriction exists whether or not anything has been written on the deed. What the third paragraph of Article 194 adds is a way to make it visible: the spouse who is not the registered owner of the immovable allocated as the family residence may ask the Land Registry Directorate to enter the necessary annotation. The phrase ‘from the Land Registry Directorate’ was inserted into that paragraph by Article 44 of Law No. 6518 of 6 February 2014, which fixed where the application goes.

          Why the annotation changes the conversation: under Article 1009 of the Civil Code, rights entered on the register by way of annotation can be asserted against people who afterwards acquire rights over that property. And under Article 1023, a third party who acquires a right in good faith relying on the register is protected. Put those together and the point of the annotation becomes obvious — once it is there, no later buyer can say they did not know.

For a foreign buyer the practical consequence is narrow but sharp. If the person selling to you is married and the property is the home the family lives in, the signature on the deed is not by itself the signature that completes your purchase. This is one of the entries worth looking for specifically when you run the encumbrance check on a Turkish title deed, alongside everything else recorded in the tapu itself.

Aile Konutu Şerhi — The Essentials

What the Turkish Civil Code provides

Turkish nameAile konutu şerhi

Legal basisCivil Code art. 194

What it protectsThe family residence

Who appliesThe non-owner spouse

WhereLand Registry Directorate

RestrictsTransfer, limiting rights, ending a lease

Consent standardExpress consent (açık rıza)

If consent refusedApply to the judge (art. 194/2)

If the home is rentedSpouse may join the lease (art. 194/4)

Does it give ownership?No

On divorceRight to stay may be annotated (art. 254)

On deathSurviving spouse may claim (arts. 240, 652)

          The buyer’s version of this problem: you are not looking for a defect in the property. It is an entry a married person can have placed on the land register against the home the family actually lives in, even when the deed is in the other spouse's sole name. Its basis is Article 194 of the Turkish Civil Code, whose third paragraph lets the spouse who is not the registered owner of the property apply to the Land Registry Directorate for the annotation to be entered. The annotation does not transfer ownership and does not give the applicant a share of the property. What it does is make a restriction that already exists in law visible on the register, so that anyone who later looks at the deed can see that the registered owner cannot deal with this particular property on their own signature.

Can a Turkish property be sold without the spouse's consent?+

Not where it is the family home. The first paragraph of Article 194 of the Turkish Civil Code provides that neither spouse may terminate the lease relating to the family residence, transfer the family residence, or limit the rights over it, without the express consent of the other spouse. The restriction attaches to the property because of what it is used for, not because of whose name appears on the deed, and it is not conditional on an annotation having been entered. The annotation's role is evidential and protective rather than constitutive: under Article 1009 of the Civil Code, rights entered on the register by way of annotation can be asserted against people who later acquire rights over that property, which closes off the argument that a buyer knew nothing about it.

Who can apply for the annotation, and where?+

The spouse who is not the registered owner. The words 'from the Land Registry Directorate' were added to that paragraph by Article 44 of Law No. 6518 of 6 February 2014, which settled where the application is made. Note what the wording restricts: it is the non-owner spouse who applies, and it applies to the immovable allocated as the family residence — not to every property the couple happens to own.

What happens if a spouse refuses to give consent?+

The second paragraph of Article 194 of the Turkish Civil Code provides that a spouse who cannot obtain consent, or to whom consent is refused without just cause, may ask for the intervention of the judge. So a refusal is not automatically the end of the matter, but the route around it runs through a court rather than around the registry. In practical terms this means a sale that needs a spouse's consent and does not have it is not a sale that can simply be pushed through at the Land Registry; it is one that either waits for consent or waits for a judicial decision. For a buyer, either outcome is a delay that belongs in the timetable before a deposit is committed, not after.

Does the annotation affect a rented home as well as an owned one?+

Yes, in a different way. Article 194 of the Turkish Civil Code deals with tenancies in two places. Its first paragraph prevents a spouse from terminating the lease of the family residence without the other spouse's express consent. Its fourth paragraph goes further: where the family residence has been secured by one spouse under a tenancy, the spouse who is not a party to that contract becomes a party to it by giving notice to the landlord, and the spouse who gives that notice becomes jointly and severally liable with the other. The effect is that a landlord can end up with two liable tenants rather than one, and cannot treat the signing spouse as the only person with standing.

How does this affect a foreign buyer purchasing in Turkey?+

It affects you from both directions. As a buyer, if the seller is married and the property is their family home, their signature alone is not enough, and you need to establish that position from the land register and the seller's civil status before money moves rather than afterwards. Article 1023 of the Civil Code protects a third party who acquires a right in good faith relying on the register, but an annotation is precisely what removes the possibility of claiming you did not know. As an owner, the same article works for you: if you buy a home in Turkey with a spouse and the deed goes into one name, the other spouse can ask for the annotation and prevent the property being sold or mortgaged on one signature.

        Check Before You Commit

Confirm the seller can actually sell

Tell us which property you are considering and we will pull the land register entry, check the annotations recorded against it, and confirm whose consent the transfer requires. Note what the wording restricts: it is the non-owner spouse who applies, and it applies to the immovable allocated as the family residence — not to every property the couple happens to own."
      }
    },
    {
      "@type": "Question",
      "name": "What happens if a spouse refuses to give consent?",
      "acceptedAnswer": {
        "@type": "Answer",
        "text": "The second paragraph of Article 194 of the Turkish Civil Code provides that a spouse who cannot obtain consent, or to whom consent is refused without just cause, may ask for the intervention of the judge. For a buyer, either outcome is a delay that belongs in the timetable before a deposit is committed, not after."
      }
    },
    {
      "@type": "Question",
      "name": "Does the annotation affect a rented home as well as an owned one?",
      "acceptedAnswer": {
        "@type": "Answer",
        "text": "Yes, in a different way. Its fourth paragraph goes further: where the family residence has been secured by one spouse under a tenancy, the spouse who is not a party to that contract becomes a party to it by giving notice to the landlord, and the spouse who gives that notice becomes jointly and severally liable with the other.
