It was drawn up in London or Berlin or Dubai, it lists the house, the pensions and the bank accounts, and somewhere in it there is a line about “any other property I may own”. The assumption is that the apartment in Antalya travels with everything else. It does not, at least not automatically, because succession to real estate located in Turkey is assessed under Turkish law and registered by a Turkish land registry that will want to see something it recognises.

Our guide to inheritance law in Turkey sets out that rule and what the heirs of a foreign owner actually have to do. This guide is the other half of the question: not what happens if you do nothing, but what the Turkish instrument looks like if you decide to do something. That instrument is the vasiyetname — a will made in one of the forms the Turkish Civil Code (Law No. 4721) recognises.

The distinction worth holding on to: making a Turkish will does not let you override Turkish succession law. It lets you make choices inside it. A vasiyetname governs the portion of your estate that is genuinely yours to direct, and the reserved shares described below sit outside your reach no matter how the document is worded.

What follows is the structure of the three recognised forms, the formalities that decide whether each one survives a challenge, the limits on what you can direct, and the sequence worth following. It is a briefing rather than legal advice. Statutory wording and practice change, every family is different, and a will is exactly the document where a formality defect only shows up when you are no longer available to fix it. Confirm the current position with a licensed Turkish lawyer before you act on anything here.

Vasiyetname — At A Glance

The framework as the sources consulted describe it

Governing statuteCivil Code No. 4721

Forms recognisedThree (Art. 531)

Official willArts. 532–537

Handwritten willArt. 538

Oral willArts. 539–541

Minimum age15 (Art. 502)

Capacity requiredSound judgement at signing

Witnesses, official willTwo

Reserved sharesArts. 505–506

Reduction actionArts. 560–571

Annulment time limitsArt. 559

Revocable?Yes, at any time

On the article numbers and fractions in this guide. The official text of Law No. 4721 is published by the Turkish government at mevzuat.gov.tr, which we were unable to reach while preparing this article. A will drawn up by an official in front of two witnesses, held on file and capable of being produced on request, is a much harder document to attack than a sheet of paper found in a drawer whose date, handwriting and the testator’s state of mind are all now matters of argument. The handwritten will is perfectly valid, and it is free — but it puts every one of those questions on your heirs at the one moment you cannot help them.

There is a language dimension too. A will that disposes of Turkish real estate will be read by Turkish officials and, if contested, a Turkish court. Turkish law recognises three: the official will, drawn up by a competent official such as a notary or a justice of the peace in the presence of two witnesses; the handwritten will, written out entirely in the testator's own hand, dated and signed; and the oral will, which is available only in extraordinary circumstances where neither of the other forms is possible. For an owner of Turkish real estate, the vasiyetname is the instrument Turkish officials and Turkish courts are set up to recognise, which is why it matters even to someone who already has a perfectly good will at home.

Does my will from my home country cover my Turkish property?+

Not in the way most owners assume. Succession to real estate located in Turkey, and the registration of that transfer at the land registry, is assessed under Turkish law, whether or not the deceased or the heir is a foreign national. A will made abroad does not displace those rules, and it may also create practical difficulty: a foreign document has to be legalised in the country that issued it and translated by a sworn translator before a Turkish court will act on it. The useful question to put to a Turkish lawyer is not whether your existing will is valid where you made it, but which of your assets Turkish law reaches and whether your current plan survives contact with those rules.

Can a Turkish will leave everything to whoever I choose?+

No. Turkish law protects a reserved portion, the saklı pay, for certain close relatives, and that portion sits outside what any will can direct. Articles 505 and 506 of the Civil Code govern it. According to the commentaries consulted for this guide, descendants are entitled to one half of their statutory share and parents to one quarter of theirs, while a surviving spouse is entitled either to the whole of their statutory share or to three quarters of it, depending on which class of heirs the spouse inherits alongside. None of the sources we consulted lists siblings among the protected heirs. Because the fractions bite on the statutory share rather than on the estate as a whole, the only way to know your free portion is to have it calculated against your actual family.

What happens if a will ignores the reserved shares?+

The will is not automatically void. A protected heir who has received less than their reserved portion can bring a reduction action, the tenkis davası, which is governed by Articles 560 to 571 of the Civil Code and cuts the excessive dispositions back far enough to restore the reserved share. That is different from an action to annul the will altogether, which attacks validity rather than quantum and is subject to the time limits in Article 559: one year from the point at which the claimant learns of the will, the ground of invalidity and their own status as a beneficiary, and in any event ten years from the opening of the will where the defendants acted in good faith, or twenty years where they did not.

Who can make a Turkish will, and can it be changed later?+

Article 502 requires the testator to have reached the age of fifteen and to have sound judgement. Capacity is assessed at the moment the will is executed rather than diagnosed in general terms, which is one practical argument for the official form where a challenge is foreseeable: the involvement of an official and two witnesses produces contemporaneous evidence that the testator knew what they were doing. A will can be freely revoked or replaced at any time while the testator retains capacity, so it is worth revisiting after a marriage, a divorce, a new child, or the sale or purchase of Turkish property.

Who cannot act as the official or a witness to a Turkish will?+

For an official will, the sources consulted for this guide exclude people who lack the capacity to act, people barred from public service by a court decision, people who cannot read and write, and the testator's spouse, descendants and blood relatives, together with the testator's siblings and their spouses. The underlying principle is that nobody with a stake in the outcome should help create the document. Involving an excluded person is one of the commonest reasons an otherwise sensible will is attacked afterwards, so the list is worth checking before the appointment rather than discovering it at the notary's desk.

Where to go next

The rest of our succession and title library for foreign owners of Turkish property.

Inheritance law in Turkey — what happens to your property when you die, and what your heirs must do.

The tapu and title deed system — how Turkish ownership is recorded and which identifiers matter.

Takyidat and encumbrance checks — reading what is registered against a property, not just who owns it.

Hisseli tapu: shared title deeds — what co-ownership gives you, and how it complicates succession.

Power of attorney in Turkey — what someone can and cannot do on your behalf.

Do you need a lawyer to buy in Turkey? — when independent Turkish legal advice earns its fee.

Legal services — title deed work, due diligence and succession support.

Turkey property guides — the full library for foreign buyers and owners.

Sources

The statutory framework described above is reproduced from the following commentaries on Turkish Civil Code No. 4721, all retrieved on 14 October 2026.
