· Foreign Owner Guide · September 2026

When the Turkish Land Register Is Wrong: Tapu Errors and Cadastral Corrections

Turkey's land register is centrally kept, publicly reliable and, occasionally, wrong. The law anticipates that. It protects the buyer who relied on it in good faith, makes the State liable for the damage its records cause, and puts hard deadlines on putting things right. Here is how those three mechanisms fit together.

⚖️ Civil Code No. 4721, Art. 1007 and 1023

📏 Cadastre Law No. 3402, Art. 41 and 12/3

🇺🇷 Written for foreign owners and buyers

Art. 1007State Liability For Register Errors

Art. 1023Protection Of The Good-Faith Buyer

30 daysTo Challenge A Cadastral Correction

10 yearsPreclusive Period, Art. 12/3

        Two Records, Not One

The register says who owns it. The cadastre says where it is. They can disagree.

Foreign buyers arrive in Turkey and are told, correctly, that the title system is strong. Ownership is recorded centrally by the General Directorate of Land Registry and Cadastre, the record is authoritative, and the transfer of a property is an act of registration rather than a private exchange of documents. Compared with jurisdictions where ownership rests on a chain of private deeds, this is a considerable advantage, and it is one of the genuine reasons Turkish property is straightforward to buy.

What that reassurance tends to flatten is that there are two records, doing two different jobs. The land register, the tapu sicili, records legal facts: who owns the parcel, in what shares, and what rights, mortgages, liens and annotations are registered against it. The cadastre records physical facts: the parcel's measured area, its boundaries and its position on the map. A property has an entry in both, and it is entirely possible for one to be impeccable while the other is wrong.

That is not a theoretical concern. Cadastral surveying in Turkey has been carried out over a long period, with varying technology and varying precision, and renewal work has in places produced registered parcel areas that differ from what was recorded before. Those changes have generated compensation claims against the State under the land-register liability provision, a pattern examined in the journal Geomatics, Natural Hazards and Risk in 2025, which noted that some discrepancies fall within tolerable survey error while others are significant enough to warrant compensation. If you own rural land, a large plot or a villa with a garden, this is the category of problem most likely to touch you.

The law's response has three parts, and they are worth separating because buyers tend to collapse them into a general sense that the system is safe. The first is protective: a person who acquires in good faith, relying on what the register says, is protected in that acquisition. The second is compensatory: where the keeping of the register causes damage, the State answers for it. The third is procedural and unforgiving: corrections and challenges run on deadlines, and those deadlines do not pause because the owner lives in another country.

It is the third that catches foreign owners. The protective and compensatory provisions are generous by international standards. The procedural ones assume an owner who is present, who receives notices at an address that is actually monitored, and who acts within weeks. An owner who visits twice a year and whose Turkish correspondence goes to an empty apartment is exposed not because the law is harsh but because the clock is indifferent.

This guide sets out what each of the two records actually contains, how errors in each are corrected, what deadlines apply, and what an owner abroad should have in place so that a notice does not expire unread. It states the provisions and the periods; it does not attempt to value a claim or predict how a court would decide one, because neither can responsibly be generalised.

The distinction that decides everything. Before anything else, establish whether the problem is in the register or in the cadastre. A wrong name, a wrong share or a stale annotation is a register matter. A wrong area, a wrong boundary or a parcel that does not sit where the map puts it is a cadastral matter. They have different procedures, different deadlines and different remedies, and a great deal of wasted effort comes from attacking the wrong one.

Land Register and Cadastre

The provisions that govern getting it wrong, and putting it right

AuthorityTKGM

Register statuteCivil Code No. 4721

State liabilityArticle 1007

Nature of liabilityStrict, without fault

RecourseState against at-fault officials

Good-faith protectionArticle 1023

Cadastre statuteLaw No. 3402

Correction of errorsArticle 41

Challenge window30 days from notification

If unchallengedCorrection becomes final

Preclusive periodArticle 12/3 — 10 years

Amended byLaw No. 7579, 22 May 2026

The notice goes to a Turkish address, and the clock starts anyway. The 30-day window under Article 41 runs from notification, not from the day you happen to find out. Each step narrows what the problem can be, and several of the later options close permanently if the early ones are skipped.

1

Pull both records, not one

Obtain the current land register entry for the parcel and the cadastral data for it. The register entry gives the owner, the shares, and the full annotations and declarations pages. The cadastral data gives the parcel's recorded area, boundaries and map position. Turkish citizens and residents can reach much of this through the state e-government service; a foreign owner will usually work through a lawyer or directly with the land registry office holding the file.

2

Compare the record against the ground

Walk the boundary against the cadastral map, and compare the recorded area against what is actually enclosed. Fences, walls, access tracks and outbuildings that have been in place for years are the usual sources of divergence, and a neighbour's structure sitting inside your parcel is a materially different problem from your own wall sitting inside theirs. Where the parcel is large, rural or irregular, this is work for a licensed surveyor rather than for a tape measure and optimism.

3

Classify the error

Decide which record is wrong. An incorrect name, identity number or ownership share, or an annotation that should have been lifted and has not been, is a register defect. An incorrect area, boundary or map position is a cadastral defect. Where both look wrong, they are usually the same underlying event recorded twice, and the cadastral question is generally the one to resolve first because the register describes a parcel the cadastre defines.

4

Use the administrative route where it exists

Cadastral errors of measurement, area and boundary are corrected administratively under Article 41 of the Cadastre Law No. 3402, rather than requiring litigation as a first step. The correction is made and then notified to the owners and other right holders. This is the quickest route available and it is worth exhausting before anything more adversarial, both because it is faster and because a contested court process starts from a worse position if the administrative option was never tried.

5

Watch the 30-day window in both directions

Once a correction under Article 41 is notified, an affected party has 30 days to bring an action in the civil court to have it cancelled, after which it becomes final. That cuts both ways. If a correction has been made that damages your position, 30 days is all you have to attack it. If a correction has been made in your favour, the same 30 days must run before you can treat the matter as settled. Diary the date from the notification, not from when you read it.

6

Consider the compensation claim separately

Fixing the register and being compensated for what the error cost you are two different proceedings. Where damage has arisen from the keeping of the land register, Article 1007 of the Civil Code makes the State liable, on a strict basis, and the State may then pursue officials at fault. Whether a claim is available on your facts, and within what period it must be brought, is genuinely contested in Turkish commentary and is not something to determine from a guide. Article 1007 of the Turkish Civil Code No. 4721 provides that the State is liable for damage arising from the keeping of the land register, and Turkish doctrine and case law treat that as strict liability, meaning liability without proof of fault by any particular official. The State then has a right of recourse against officials who were at fault. The practical significance for a foreign owner is that a registry error is not automatically a loss you simply absorb. It may found a claim for compensation against the State, brought through the courts, separately from whatever is happening to the register entry itself.

Am I protected if I bought in good faith and the register was wrong?+

In many cases yes, and this is the single most important feature of the Turkish system for a foreign buyer. Under Article 1023 of the Turkish Civil Code, a third party who acquires a right in rem in good faith in reliance on the land register is protected in that acquisition. The register is designed to be relied upon, and someone who reads it properly, acts on what it says and has no knowledge of any defect is in a far stronger position than someone who did not look. Good faith is the condition, though, and it is assessed against what you knew or should have known. A buyer who ignored an obvious discrepancy, or who was told about a problem and proceeded anyway, is not protected by this provision.

What is the difference between a tapu error and a cadastral error?+

They sit in different places and are corrected by different routes. A tapu error is a defect in the land register itself: a misspelled name, a wrong identity number, a share recorded incorrectly, an annotation that should have been removed. A cadastral error is a defect in the underlying survey: the parcel's measured area, its boundaries or its position on the cadastral map do not match reality on the ground. The distinction matters because the register describes ownership while the cadastre describes the physical parcel, and a property can have a perfectly clean register entry attached to boundaries that are wrong. Establishing which of the two you are dealing with is the first step, because it determines both the procedure and the deadline.

How long do I have to challenge a cadastral correction?+

Thirty days from notification. This provision was among those amended by Law No. 7579, published in the Official Gazette on 22 May 2026. For an owner living abroad the practical risk is obvious: the window runs from notification, and a notice that arrives at a Turkish address nobody is checking can expire before you have any idea it was sent.

Is there a point after which cadastral records can no longer be challenged?+

Yes, and it is one of the most consequential provisions in Turkish property law. Article 12/3 of the Cadastre Law No. 3402 provides that once ten years have passed from the date the cadastral records became final, no objection may be raised and no action may be brought on legal grounds that predate the cadastre. The effect is to close off historical ownership claims and give the cadastral determination a settled quality. The scope of that ten-year preclusive period is genuinely contested in Turkish case law and academic commentary, particularly around which kinds of claim it does and does not extinguish, so it is not a provision to rely on from a summary. It is a provision to put to a Turkish lawyer on the specific facts.

Should I get the boundaries checked before buying land in Turkey?+

For any purchase where the parcel boundary matters, yes, and the more rural or the larger the plot, the more strongly yes. The land register will tell you who owns the parcel and what is registered against it, but it will not tell you whether the fence, the wall, the access track or the neighbour's outbuilding sits where the cadastral map says the boundary sits. Discrepancies between the recorded parcel and the occupied ground are common enough to be a normal part of buying land rather than an exotic risk, and they are far cheaper to discover before completion than after. The General Directorate of Land Registry and Cadastre is the authority for the cadastral position, and a check against the official parcel data is inexpensive relative to what it protects.

    Keep Reading

Where to go next

The register is the thing every other stage of a Turkish purchase depends on. Discrepancies between the recorded parcel and the occupied ground are common enough to be a normal part of buying land rather than an exotic risk, and they are far cheaper to discover before completion than after. The General Directorate of Land Registry and Cadastre is the authority for the cadastral position, and a check against the official parcel data is inexpensive relative to what it protects."
      }
    }
  ]
}

Turkey’s land register is centrally kept, publicly reliable and occasionally wrong.
