Whatever stands on a parcel of land — a house, a workshop, a boundary wall, a well, a stand of fruit trees — is treated as an integral part of that land, a bütünleyici parça, and belongs to whoever owns the land. There is no separate ownership of the building. Buy the parcel and you buy everything permanently attached to it.

Applied without exception, that rule produces obvious unfairness. Someone who spends years and real money building a house on land belonging to a relative, a business partner or a co-heir would simply lose it. Turkish law’s answer was not to break the unity of ownership but to create a parallel concept: muhdesat. The register notes that a particular structure or planting was created by someone other than the owner, and that person acquires a claim to its economic value — while ownership of the land, and of everything on it, stays exactly where it was.

          The distinction that matters to a buyer: a muhdesat entry is not a co-ownership claim and it is not a charge. It does not stop the owner selling to you and it will not appear as an encumbrance. What it does is put a third party’s economic claim on the public record — so that when the parcel is one day divided, expropriated or redeveloped, part of its value is routed to them rather than to you.

This guide explains what counts as muhdesat, where it is recorded and why that column matters more than the words in it, what it does and does not do to a sale, and the narrow circumstances in which the underlying claim can actually be brought. It is written for buyers looking at Turkish land rather than apartments — see our guides to buying land in Turkey and agricultural land for the wider picture.

Muhdesat — The Legal Position

What the register entry actually means

Governing principleSuperficies solo cedit

Civil Code articlesTMK 722, 724, 729

Register basisCadastre Law art. 19/2

Recorded inDeclarations column

Nature of the rightPersonal claim

A real right?No

Blocks a sale?No

Blocks a mortgage?No

Register is publicTMK art. 1020

Good-faith protectionUnavailable

Claim becomesA money claim

Basis of compensationUnjust enrichment

          Read the declarations column, not just the front of the deed. Muhdesat does not appear among the encumbrances a buyer is normally shown. Three of those columns matter here, and conflating them is the source of most confusion about muhdesat.

The ownership column records who owns the property. The annotations column — the şerhler hanesi — is where personal rights are given effect against third parties; an entry here genuinely binds people who come later and can restrict what the owner may do. The declarations column, the beyanlar hanesi, is different in kind. It records matters of fact about the physical or legal state of the parcel. It informs; it does not restrict.

Muhdesat is recorded in the declarations column. Article 19/2 of the Cadastre Law (Law No. 3402) provides that where a muhdesat on an immovable belongs to someone other than the owner, or to one of the co-owners, its owner, its type, the date it was created and the reason for its acquisition are shown in the declarations column of the record and the register. The entry is a belirtme — a notation of fact. It is not a restriction on the owner’s power to deal with the land, and the Land Registry will process a sale or a mortgage over the parcel without regard to it.

        So what is the entry for? Publicity. Article 1020 of the Turkish Civil Code makes the land register public and provides that nobody may claim ignorance of an entry in it. By placing the muhdesat where everyone can see it, the law converts a private arrangement into public knowledge — and with that, removes the later buyer’s ability to claim they acquired in good faith under Article 1023.

That is the whole mechanism, and it is more elegant than it first appears. The owner keeps full ownership and full freedom to sell. The builder keeps a claim to the value of what they built. And the buyer, because the register is public, is taken to have known about that claim and cannot later complain of it. Nobody’s rights are suspended; they are simply made visible.

The practical lesson for due diligence is straightforward. Checking the ownership column and the encumbrances is not enough on a land purchase. Pull the full register record and read the declarations column too — the same discipline we set out in our guide to reading the encumbrances on a Turkish title deed, and reachable through the Web Tapu online land registry.

    Tell Them Apart

Muhdesat compared with the things it is mistaken for

Three arrangements can all result in a building standing on land that is not obviously the builder’s. Muhdesat is not an exception to the rule at all — it leaves the rule intact and compensates the builder in money instead.

      The Narrow Door

When the claim can actually be brought — and what it turns into

Because muhdesat gives no real right, there is no general action to have a court declare that the building “belongs” to the person who put it up. The Court of Cassation has stated the rule directly: as a matter of principle, it cannot be sought that a muhdesat belongs to anyone other than the owner of the land.

What exists instead is a narrower remedy, the action to establish the attribution of a muhdesat — the muhdesatın aidiyetinin tespiti davası. Turkish courts treat a current legal interest as a condition of bringing it, and in practice that confines it to three situations, all of which share a common feature: the parcel’s value is about to be converted into money or redistributed, so the question of who is entitled to part of that value stops being academic.

Dissolution of co-ownership — ortaklığın giderilmesi, also known as izale-i şuyu, where jointly held land is to be divided or sold.

Expropriation — where the state takes the land and compensation has to be apportioned. Our guide to kamulaştırma covers that process.

Urban transformation — where a parcel is redeveloped and entitlements in the new scheme have to be allocated. An action to dissolve co-ownership is heard between the co-owners only. A third party who is not a co-owner cannot be awarded a share of the sale price in those proceedings; their route is a separate claim under the general law of obligations, or in the right circumstances an application to have a title action treated as a preliminary question.

        What the right converts into is money, not property. Where a muhdesat claim succeeds, the holder receives compensation rather than any interest in the land. The prevailing view bases that compensation on unjust enrichment, with the Turkish Code of Obligations distinguishing between a good-faith recipient, liable only for what remains in their hands, and a bad-faith one, liable for the whole of the enrichment.

How the sum is measured is itself contested. Rather than simply updating what the structure originally cost to build, the better view assesses the proportion of the parcel’s current sale value attributable to the muhdesat. For trees and plantings, valuation is generally approached through an income method based on net yield. These are matters for a court-appointed expert, and they are a good illustration of why a muhdesat entry on a parcel you are considering is a question for a Turkish lawyer rather than something to resolve by reading the deed.

    Before You Buy

How to check for muhdesat on a parcel

None of this is difficult. It appears because Turkish property law begins from the opposite assumption. Under the principle inherited from Roman law as superficies solo cedit, whatever stands on a piece of land is treated as an integral part of it (bütünleyici parça) and belongs to the landowner. Muhdesat is the register’s way of noting that someone else put it there and has an economic claim arising from that, without disturbing the rule that the land and everything on it is owned by one person.

Does a muhdesat entry mean somebody else owns the building?+

No, and this is the single most common misunderstanding. A muhdesat record does not split ownership. The Court of Cassation has put it plainly: muhdesat is a personal right under Articles 722, 724 and 729 of the Turkish Civil Code, and it confers on its holder no independent ownership and no limited real right separate from ownership of the land (Court of Cassation, 7th Civil Chamber, 13 June 2024, E. 2023/3864, K. 2024/3512, consistent with the unifying decision of 22 December 1995, E. 1994/1, K. 1995/3). The person named still owns nothing in the land-law sense. What they hold is a claim to the economic value of what they built, enforceable as a debt rather than as a property right.

Where on the register does muhdesat appear, and why does that matter?+

It appears in the declarations column — the beyanlar hanesi — and the column it sits in determines everything about its legal weight. Under Article 19/2 of the Cadastre Law (Law No. 3402), where there is a muhdesat on an immovable belonging to someone other than the owner or to one of the co-owners, its owner, its type, the date it was created and the reason it was acquired are shown in the declarations column of the record and the register. That is not the ownership column, which records who owns the property, and it is not the annotations column, which gives personal rights effect against third parties. The declarations column records matters of fact. A muhdesat entry is therefore a statement about the physical state of the parcel, not a restriction on it.

Can the owner still sell or mortgage land that carries a muhdesat entry?+

Yes. Because the entry sits in the declarations column rather than the annotations column, it does not restrict the owner’s power of disposal at all. The registered owner can sell the land, mortgage it or otherwise deal with it exactly as if the entry were not there, and the Land Registry will not refuse the transaction on account of it. This surprises buyers who assume that anything written on a tapu must be a blocking entry. It is not. What the entry does instead is make the situation public, and the consequences of that fall on the buyer rather than on the seller.

If I buy land with a muhdesat entry, can I say I did not know about it?+

No. Article 1020 of the Turkish Civil Code provides that the land register is public and that nobody may claim to have been unaware of an entry in it. Once a muhdesat is shown in the declarations column, the information is treated as known to everyone. A buyer who acquires the parcel afterwards cannot therefore rely on the protection that Article 1023 gives to a person acquiring in good faith on the strength of the register, because as against that entry they are not in good faith. In practical terms you take the land knowing that a third party has a recognised claim to the value of something standing on it, and you take it with your eyes open whether or not you actually read the page.

When can someone actually bring a claim over a muhdesat?+

Not at will, and this is a genuine limit rather than a formality. The action to establish who a muhdesat belongs to — the muhdesatın aidiyetinin tespiti davası — is not a free-standing remedy that can be launched whenever a dispute arises. Turkish courts require a current legal interest, which in practice confines it to a small set of situations where the value of the parcel is about to be converted into money or redistributed: an action to dissolve co-ownership (ortaklığın giderilmesi, also called izale-i şuyu), expropriation by the state, and urban transformation. Outside those situations there is generally no admissible claim. It appears because Turkish property law begins from the opposite assumption. Under the principle inherited from Roman law as superficies solo cedit, whatever stands on a piece of land is treated as an integral part of it (bütünleyici parça) and belongs to the landowner. Muhdesat is the register’s way of noting that someone else put it there and has an economic claim arising from that, without disturbing the rule that the land and everything on it is owned by one person."
      }
    },
    {
      "@type": "Question",
      "name": "Does a muhdesat entry mean somebody else owns the building?",
      "acceptedAnswer": {
        "@type": "Answer",
        "text": "No, and this is the single most common misunderstanding. A muhdesat entry is therefore a statement about the physical state of the parcel, not a restriction on it."
      }
    },
    {
      "@type": "Question",
      "name": "Can the owner still sell or mortgage land that carries a muhdesat entry?",
      "acceptedAnswer": {
        "@type": "Answer",
        "text": "Yes. The registered owner can sell the land, mortgage it or otherwise deal with it exactly as if the entry were not there, and the Land Registry will not refuse the transaction on account of it. This surprises buyers who assume that anything written on a tapu must be a blocking entry. It is not. What the entry does instead is make the situation public, and the consequences of that fall on the buyer rather than on the seller."
      }
    },
    {
      "@type": "Question",
      "name": "If I buy land with a muhdesat entry, can I say I did not know about it?",
      "acceptedAnswer": {
        "@type": "Answer",
        "text": "No. Article 1020 of the Turkish Civil Code provides that the land register is public and that nobody may claim to have been unaware of an entry in it. A buyer who acquires the parcel afterwards cannot therefore rely on the protection that Article 1023 gives to a person acquiring in good faith on the strength of the register, because as against that entry they are not in good faith. In practical terms you take the land knowing that a third party has a recognised claim to the value of something standing on it, and you take it with your eyes open whether or not you actually read the page."
      }
    },
    {
      "@type": "Question",
      "name": "When can someone actually bring a claim over a muhdesat?",
      "acceptedAnswer": {
        "@type": "Answer",
        "text": "Not at will, and this is a genuine limit rather than a formality.
