It asks what the approved plan permits on that specific parcel — and it publishes the answer in a single certificate any owner can request. For land buyers it is the difference between a building plot and a field. For apartment buyers it is how you find out whether the block you are viewing was built within its permissions, or beyond them.

📜 Zoning Law No. 3194📏 TAKS, KAKS and setbacks🏙️ Issued by the belediye

3194The Zoning Law behind the certificate

TAKSHow much of the plot you may cover

KAKSHow much floor area you may build

30%Ceiling on emsal-exempt areas

      The Document

One certificate, and what it is actually for

The imar durumu belgesi — known colloquially as the imar çapı — is the official statement of what a given parcel may be used for and under what building conditions. It reflects the approved implementation plan (uygulama imar planı) and the plan notes that apply to that parcel. Its legal footing sits in Zoning Law No. 3194 and in the Planned Areas Zoning Regulation (Planlı Alanlar İmar Yönetmeliği).

Who issues it depends on where the land sits. Inside municipal boundaries and adjacent development areas, the municipality’s planning department issues it. Outside those limits, the provincial administration does. Either way it is requested by the owner or an authorised representative, normally against a title record extract and a surveyor’s site sketch.

Here is the part foreign buyers routinely miss. The certificate is not a building permit and it is not proof of ownership. It does not authorise a single block of concrete. It answers one narrower question: given the plan in force today, what could lawfully be built on this parcel? The permission to actually build is a separate instrument, the yapı ruhsatı, and the sign-off on the finished structure is a third, the habitation certificate.

That narrowness is exactly what makes it valuable. It is an objective statement from the planning authority, not a developer’s brochure, and it is available before you commit. Where a seller’s description and the certificate disagree, the certificate is the one that will still be true after you have paid.

Who it matters to. If you are buying land, the certificate is the whole transaction — it is what separates a building plot from an agricultural field. If you are buying an apartment, it matters differently: it lets you test whether the block you are standing in was built within the envelope its parcel allowed, which is one of the commonest reasons a building never receives its habitation certificate.

The certificate describes today, not forever. It reflects the plan currently in force. Plans are amended, and a parcel’s permissions can change with them. It also cannot cure a plan that is itself legally defective. Treat it as an accurate snapshot rather than a guarantee, and check the date on the copy you are shown — municipalities commonly mark these certificates with a validity period of around a year.

İmar Durumu — At A Glance

What the certificate is, and what it is not

Legal basisZoning Law No. 3194

Detailed rulesPlanned Areas Zoning Regulation

Issued byMunicipality, or the province outside it

Requested byOwner or authorised representative

Usually requiresTitle record + site sketch

Is it a building permit? No — that is the yapı ruhsatı

Is it proof of ownership? No — that is the tapu

Does it survive plan changes? No — it reflects the current plan

Typical stated validityAround one year

Service standardTwo working days

The Process
How to run a zoning check before you commit

The sequence below is the order that surfaces problems early, while you can still walk away without having paid for them.

1

Get the parcel identity, not the address

A Turkish parcel is identified by province, district, neighbourhood, and its block and plot numbers (ada and parsel). Each document has to be seen, and seen for the right parcel.

This also explains why Turkey has repeatedly legislated to deal with structures that were never regularised.
